Welcome to North Channel Publishing.
These Terms of Use (“Terms”) govern your access to and use of northchannelpublishing.com and the websites, digital content, Discoveries, publications, downloads, maps, guides, educational materials, and other services offered by North Channel Publishing, LLC (“North Channel,” “we,” “our,” or “us”).
By accessing or using the website, creating an account, purchasing or redeeming a Discovery, or otherwise using North Channel content or services, you agree to these Terms.
If you do not agree with these Terms, please do not use the website or North Channel services.

1. ABOUT NORTH CHANNEL
North Channel Publishing creates historically researched, place-based educational experiences designed to help people discover the stories connected to real places, explore those places thoughtfully, and carry what they learn forward.
North Channel Discoveries may include historical information, maps, suggested routes, photographs, archival material, field prompts, nature study, educational activities, downloadable materials, audio or digital content, and recommendations for visiting real-world locations.
North Channel is an independent publisher and educational resource. Unless expressly stated otherwise, North Channel is not affiliated with, endorsed by, or operated by the parks, museums, governmental agencies, property owners, historical organizations, businesses, tribes, archives, or other third parties referenced in our materials.

2. ELIGIBILITY AND ADULT ACCOUNTS
North Channel accounts, purchases, licenses, subscriptions, and online submissions are intended for adults age 18 or older.
Children may participate in North Channel Discoveries under the supervision of a parent, guardian, educator, or other responsible adult, but children should not independently create accounts, make purchases, or provide personal information through the website.
If you create an account or make a purchase, you represent that you are legally able to enter into these Terms.

3. NORTH CHANNEL DISCOVERIES
A North Channel Discovery is a curated educational and exploratory experience.
Discoveries may encourage users to visit parks, trails, waterways, historic sites, public spaces, museums, businesses, or other locations.
Information is prepared with care, but conditions in the real world may change after publication. Routes, access points, water levels, weather, construction, seasonal conditions, closures, operating hours, property boundaries, regulations, facilities, and other circumstances may change without notice.
You are responsible for determining whether a location and activity are appropriate for you and the people in your care at the time of your visit.

4. OUTDOOR ACTIVITIES AND ASSUMPTION OF RISK
Exploration of real-world places may involve inherent risks.
Depending on the Discovery, these may include uneven terrain, rocks, roots, stairs, steep slopes, wildlife, insects, changing weather, water, currents, slippery surfaces, falling objects, traffic, bicycles, boats, recreational activities, remote areas, limited cellular service, and other natural or human-made hazards.
By choosing to participate in an activity described or suggested by North Channel, you acknowledge that:

• participation is voluntary;

• you are responsible for evaluating current conditions;

• you are responsible for your own abilities, equipment, transportation, and preparation;

• children and minors must be appropriately supervised;

• you will follow current signs, closures, laws, rules, and instructions from landowners or managing authorities;

• you will remain on authorized public routes and areas unless you independently obtain permission to do otherwise; and

• you assume the ordinary and inherent risks associated with the activities you choose to undertake.

North Channel does not control the physical locations described in our publications and cannot guarantee their condition, accessibility, availability, or safety.
Nothing in a Discovery should be interpreted as permission to enter private property, restricted areas, closed trails, hazardous locations, or otherwise unauthorized areas.

5. SAFETY INFORMATION
North Channel materials are educational and informational in nature.
They are not a substitute for current information from park authorities, land managers, emergency personnel, weather services, transportation agencies, or other responsible authorities.
Always follow current posted signage, warnings, restrictions, closures, and local regulations even if they differ from information contained in a North Channel Discovery.
If conditions appear unsafe, do not proceed.

6. DISCOVERY LICENSES
Purchasing a North Channel Discovery gives you a license to use the content. It does not transfer ownership of North Channel intellectual property.
The applicable license depends upon the manner in which the Discovery was purchased or provided.
Household Discovery License
Permits personal, noncommercial use by one household or family.
Educator / Group Discovery License
Permits use by the purchasing educator or group leader with the class, homeschool group, co-op, scout group, or other defined group covered by that purchase.
Local Partner License
Permits approved commercial or guest-facing use by participating hotels, resorts, inns, concierges, vacation-rental hosts, professional guides, real estate professionals, relocation specialists, tourism providers, and other approved local partners according to the specific rights granted by North Channel.
Organization License
Permits approved use by the museum, school, library, tourism organization, camp, institution, or other organization identified in the applicable agreement.
Additional terms may accompany certain licenses. If license-specific terms conflict with these general Terms, the applicable written license agreement will control for that use.

7. WHAT YOUR LICENSE DOES NOT ALLOW
Unless North Channel gives you express written permission, you may not:

• reproduce or distribute complete Discoveries;

• upload Discoveries or downloads to shared drives, public websites, social platforms, file-sharing services, or resource libraries;

• share account credentials or redemption links outside the licensed household or organization;

• resell North Channel materials;

• remove copyright, trademark, licensing, watermark, attribution, or ownership notices;

• substantially copy North Channel routes, research, writing, prompts, educational structure, or materials and present them as your own;

• use North Channel content to create a competing commercial tour, guide, publication, curriculum, product, or service;

• use a Household or Educator license for commercial guest or client experiences; or

• reproduce archival materials or third-party content beyond the rights specifically provided.

Reasonable printing of materials expressly designated as printable is allowed within the scope of the applicable license.

8. INTELLECTUAL PROPERTY
Unless otherwise identified, the North Channel website and original North Channel content—including text, writing, editorial structure, Discovery design, illustrations, graphics, maps, branding, logos, photographs, compilations, downloadable materials, and other original works—are owned by or licensed to North Channel Publishing, LLC and are protected by applicable intellectual-property laws.
North Channel Publishing, North Channel, the North Channel identity, Discovery branding, and related marks may not be used in a manner that suggests affiliation, sponsorship, endorsement, or authorization without written permission.
Historical photographs, documents, quotations, maps, artwork, or archival resources appearing within a Discovery may have separate copyright or licensing conditions. Their inclusion in a North Channel publication does not necessarily grant users independent rights to reuse those materials.

9. HISTORICAL AND EDUCATIONAL CONTENT
North Channel is committed to careful research and historical accuracy.
History is sometimes incomplete, contested, newly discovered, or interpreted differently by credible sources. North Channel may revise Discoveries as new evidence, scholarship, community knowledge, archival material, or corrections become available.
We do not guarantee that every historical source is complete or that future research will not alter an interpretation presented in a Discovery.
We welcome documented corrections and additional primary-source information.

10. FLORA, FAUNA, GEOLOGY, AND NATURAL INFORMATION
Nature-related information contained in North Channel materials is provided for general educational purposes.
Identification of plants, wildlife, fungi, geological formations, environmental conditions, or other natural features should not be relied upon for medical, edible-foraging, survival, veterinary, environmental-compliance, or other professional decisions.
Never consume or handle a plant, mushroom, animal, mineral, or other natural material solely because of information contained in a North Channel publication.

11. THIRD-PARTY LOCATIONS AND SERVICES
North Channel may mention or link to parks, museums, archives, accommodations, restaurants, outfitters, businesses, government agencies, tribal organizations, attractions, transportation providers, or other third parties.
Such references do not guarantee availability, quality, safety, accuracy, or continued operation.
Your dealings with third parties are between you and the applicable third party and may be subject to their own terms, rules, admission requirements, fees, waivers, and privacy policies.

12. PURCHASES AND PAYMENT
Purchases made through North Channel are subject to the price, license type, fulfillment method, and other terms displayed at the time of purchase.
You agree to provide accurate billing, shipping, and account information.
North Channel may correct pricing or product-description errors, cancel fraudulent or unauthorized transactions, and limit purchases where reasonably necessary to protect the business or its intellectual property.
Additional policies governing shipping, returns, refunds, cancellations, preorders, and physical products may be provided through separate Terms of Sale / Refund & Shipping Policy.

13. GIFT DISCOVERIES
A purchaser may be able to send a Discovery to another person digitally or through a physical gift product.
Gift redemption codes, QR codes, or links are intended for the named or intended recipient and may be limited to one redemption.
Once claimed, the applicable Discovery license may become associated with the recipient's account.
Gift recipients are not automatically subscribed to marketing communications merely because another person purchased a gift for them.

14. ACCOUNTS AND SECURITY
You are responsible for maintaining the confidentiality of your account credentials and for activity occurring through your account.
You agree not to knowingly allow unauthorized people to access licensed North Channel content through your account.
Please contact North Channel if you believe an account, redemption code, or Discovery has been accessed without authorization.

15. ACCEPTABLE USE
You may not use North Channel websites or services to:

• violate applicable law;

• interfere with website operation or security;

• attempt to bypass access controls or licensing restrictions;

• scrape, harvest, systematically download, or extract North Channel content;

• introduce malicious code;

• impersonate another person or organization;

• fraudulently obtain access to paid materials;

• use automated systems to create unauthorized copies of North Channel content; or

• engage in conduct that materially interferes with another person's use of the services.
   

16. STORY SUBMISSIONS AND CONTRIBUTIONS
North Channel may invite community members to submit stories, photographs, historical leads, memories, documents, corrections, location suggestions, or other information.
Submitting something for consideration does not automatically transfer ownership of it to North Channel.
You represent that you have the right to submit the material you provide.
Submitting material gives North Channel permission to review and internally evaluate it for possible editorial use. If North Channel wishes to publish, reproduce, adapt, or otherwise commercially use submitted material beyond ordinary review, we may request additional permission, attribution information, rights documentation, or a separate written agreement where appropriate.
Please do not submit confidential information or materials you are not authorized to share.

17. REVIEWS, FEEDBACK, AND PILOT PARTICIPATION
If you voluntarily provide feedback, comments, suggestions, survey responses, testing observations, or ideas concerning North Channel products or services, North Channel may use that feedback to improve its publications, services, and business without compensation or obligation to you.
This does not transfer ownership of separately copyrighted creative work you submit.

18. LINKS TO OTHER WEBSITES
Our website may contain links to third-party websites.
North Channel does not control and is not responsible for the content, policies, accuracy, security, or practices of third-party websites.
A link does not necessarily constitute endorsement.

19. DISCLAIMER OF WARRANTIES
To the fullest extent permitted by applicable law, the website and North Channel materials are provided on an “as available” and “as is” basis.
North Channel does not guarantee uninterrupted website availability or that every piece of information will remain current, complete, or error-free.
Nothing in these Terms excludes warranties or protections that cannot legally be excluded.

20. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, North Channel Publishing, LLC and its owners, employees, contractors, contributors, and representatives will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the website or North Channel materials.
Nothing in these Terms is intended to exclude or limit liability that cannot lawfully be excluded or limited.
Because laws concerning releases, waivers, recreational activities, and liability vary by jurisdiction, North Channel may require an additional acknowledgement or agreement before certain activities or experiences.

21. INDEMNIFICATION
To the extent permitted by law, you agree to be responsible for claims, damages, losses, or expenses arising from your unlawful use of North Channel services, violation of these Terms, infringement of another person's rights, or unauthorized commercial use or distribution of North Channel materials.

22. SUSPENSION OR TERMINATION
North Channel may suspend or terminate access to an account or licensed content when reasonably necessary because of fraud, misuse, unauthorized distribution, security concerns, material violation of these Terms, or legal requirements.
Termination does not grant permission to retain or continue distributing North Channel materials beyond rights that survive termination.

23. CHANGES TO SERVICES AND CONTENT
North Channel may update, revise, expand, discontinue, or replace website features, Discoveries, materials, prices, and services.
Purchased digital Discoveries may also be updated to improve accuracy, safety information, accessibility, editorial quality, or functionality.

24. CHANGES TO THESE TERMS
We may update these Terms as our services evolve or legal requirements change.
The current version will be posted on our website with an updated Last Updated date.
Material changes may receive additional notice where appropriate.

25. GOVERNING LAW
These Terms are governed by the laws of the State of Idaho, without regard to conflict-of-law principles.
Unless applicable law requires otherwise, disputes concerning these Terms or North Channel services will be brought in an appropriate state or federal court located in Idaho.

26. SEVERABILITY
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

27. ENTIRE AGREEMENT
These Terms, together with the Privacy Policy and any applicable purchase, license, or program-specific terms, constitute the agreement governing use of North Channel services.
